Terms of sale

These terms apply to every order placed with Foshan Gumei Aluminum Art Building Materials Co., Ltd. (Gumei Medals), 4F, Building 22, South China Hardware & Decoration City, Nanhai District, Foshan, Guangdong, China. A written quotation or proforma invoice from us may add details for a specific order; where it differs from these terms, the quotation or invoice applies.

1. Quotations

We quote each order individually based on the product, size, material, craft, colours, finish, attachments, packaging, quantity and delivery terms you give us. If any of these change, the price and lead time may change, and we will send a revised quotation before going ahead.

2. Minimum order

The minimum order is 100 pieces per design, unless we agree otherwise in writing.

3. Design and artwork

Design draft and vector artwork prepared by our team. The fee is confirmed in your quotation before any design work starts.

Before production we send you a colour design draft and then production vector artwork. You are responsible for checking every proof: spelling, names, dates, numbers, colours, dimensions, attachments and quantities. Once you approve the vector artwork in writing, we produce exactly what it shows. Errors in an approved proof are not a defect.

4. Intellectual property and permitted use

By sending us artwork, logos, names, characters or trademarks, you confirm that you own them or have the right to reproduce them, and you accept responsibility for any claim that the finished goods infringe someone else's rights. We may ask for proof of ownership or a licence and may refuse any order we believe infringes third-party rights.

• Anime, game and fan badges: you must own or license the intellectual property, or use original artwork.
• Police, law enforcement and security badges, and decorations of public authorities: made to your artwork on your instruction. You confirm that you are entitled to use the insignia, that you have any permit or authorisation your own law requires, and that you will use and resell the finished badges lawfully. Responsibility for the design, for the order and for its use rests with you; we do not verify authorisation and we are not liable for any unlawful use of the goods by you or your customers.

Dies and moulds made for your order are used only for your designs. We do not sell products made from your artwork to anyone else.

The mould fee is RMB 3,000 per design, charged once; we keep the mould for repeat orders. Repeat orders of the same design do not pay the mould fee again.

5. Samples

We start the mould after you approve the vector artwork and pay the deposit. A pre-production sample takes 7 days.Charged per sample based on your unit quote. Mass production starts only after you approve the sample.

6. Payment

50% deposit, 50% balance before shipment. Production starts when we receive the deposit. Goods ship when we receive the balance. Bank charges on your side are paid by you.

7. Lead times

Lead times start the day after we receive your deposit, which you pay after approving the vector artwork. The pre-production sample is ready in 7 days, and the finished goods in 14 days in total, sample included. The time you take to approve the sample, and any late approval, moves the ship date by the same number of days. Shipping time is added on top and depends on the delivery method. If you have a fixed event date, tell us when you request a quote so we can confirm whether it can be met.

8. Delivery and Incoterms

We ship DDP by air, DDP by sea, CIF, EXW, interpreted under Incoterms® 2020. The agreed Incoterm sets who pays for freight, insurance, duties and taxes, and when the risk passes to you.

• DDP: we arrange freight, customs clearance and import duties to your address.
• CIF: we pay freight and insurance to your destination port; you handle import clearance.
• EXW: you or your forwarder collect the goods from our factory.

Every order comes with a proforma invoice (PI) before payment, and a commercial invoice and packing list with the shipment.

Delays caused by carriers, customs or events outside our control are not our responsibility, but we will help you track and resolve them.

9. Inspection, defects and claims

Every batch is inspected against the approved sample before packing. Please check your goods when they arrive. If anything is defective, damaged or short, contact us within 7 days of delivery with photos of the affected pieces, the cartons and the shipping labels.

If the problem is caused by our production, we either refund the affected pieces in full or remake them and ship the replacements to you at our cost, as agreed with you. Claims do not cover differences that were visible on the approved proof or sample, normal colour variation between enamel and printed or on-screen colours, or damage from misuse after delivery.

10. Cancellations and changes

You can change or cancel an order free of charge before you approve the vector artwork. After that, costs already incurred, such as design work, dies, moulds, materials and production completed, are deducted from your deposit or charged to you.

11. Liability

Our total liability for any order is limited to the price paid for the affected goods. We are not liable for indirect losses such as loss of profit or event costs. Nothing in these terms limits liability that cannot be limited by law.
